Acceptable Use Policy

We’ve reorganized and updated our Acceptable Use Policy as of 18th January 2019 to make the terms easier to read and understand.

This Acceptable Use Policy (“AUP”) governs your use of the Services and is incorporated by reference into Mondoze Malaysia’s Terms of Service. Unless otherwise stated, defined terms in this AUP have the same meaning as provided in the Terms of Service. Mondoze Malaysia may modify this AUP at any time without notice.

The Services provided by Mondoze Malaysia may only be used for lawful purposes. You agree to comply with all applicable laws, rules and regulations in connection with your use of the Services. Mondoze Malaysia reserves the right to refuse service to anyone at our sole discretion. Any material or conduct that in our judgment violates this AUP in any manner may result in suspension or termination of the Services or removal of content with or without notice.
A: Failure to respond to a communication from our abuse department within the specified time period in our communication to you may result in the suspension or termination of the Services.
You may not directly or indirectly use the Services in connection with any of the following, as determined in Mondoze Malaysia’s sole discretion:
1. Prohibited Use or Content
You may not use the Services to publish content or engage in activity that is illegal under applicable law, that is harmful to others, or that would subject Mondoze Malaysia to liability, including, without limitation, in connection with any of the following, each of which is prohibited under this AUP:
  • a) Disclosing sensitive personal information about others;
  • b) Storing personal or sensitive information, including without limitation, “Protected Health Information” as defined under the U.S. Health Insurance Portability and Accountability Act (“HIPAA”);
  • c) Phishing or engaging in identity theft;
  • d) Distributing computer viruses, worms, Trojan horses or other malicious code;
  • e) Promoting or facilitating prostitution or sex trafficking;
  • f) Hosting ponzi or pyramid schemes, or websites that engage in unlawful or deceptive marketing practices;
  • g) Hosting, distributing or linking to child pornography (any such content will be suspended immediately without notice and reported to law enforcement or the National Center for Missing and Exploited Children) or content that is harmful to minors;
  • h) Distributing pornography or adult related content or offering any escort services;
  • i) Engaging in the unlawful distribution of controlled substances, drug contraband or prescription medications (including without limitation, promotion, marketing, or sale of prescription medications without a valid prescription);
  • j) Gambling or selling weapons or ammunition;
  • k) Promoting or facilitating violence or terrorist activities; or
  • l) Infringing the intellectual property or other proprietary rights of others.
2. Excessive Use of Resources or Network Abuse
You may not consume excessive amounts of server or network resources or use the Services in any way which results in server performance issues or which interrupts service for other customers. Prohibited activities that contribute to excessive use, include without limitation:
  • a) Hosting or linking to an anonymous proxy server;
  • b) Operating a file sharing site;
  • c) Scripts or processes that adversely impact our systems; or
  • d) Utilizing software that interfaces with an Internet Relay Chat (IRC) network.
3. Unauthorized System Access
You may not directly or indirectly use the Services to gain access to any network or system without permission, including without limitation:
  • a) Accessing another network without permission, including to probe or scan for vulnerabilities or breach security or authentication measures;
  • b) Attacking other networks (e.g., utilizing botnets or other means to launch Denial of Service (DoS) or other attacks);
  • c) Intercepting or monitoring data without permission; or
  • d) Using any deep-link, page-scrape, robot, crawl, index, spider, offline reader, click spam, macro programs, internet agent, or other automatic device, program, algorithm or methodology, to use, access, copy, index, acquire information, generate impressions or clicks, input information, store information, search, generate searches, or monitor any portion of Mondoze Malaysia’s website or servers for any unauthorized purpose.
4.Storage of Backups
You may not use your hosting account as a backup solution. Our Services are designed to host your website only and may not be used as a data repository. Mondoze Malaysia reserves the right to remove backups from your hosting account with or without notice.
5. Zero Tolerance Spam Policy
  • a) Any user account which causes or results in our IP space being blacklisted will be immediately suspended and/or terminated.
  • b) Forging or misrepresenting message headers is prohibited.
  • c) Websites advertised via spam (i.e. “Spamvertised”) may not be hosted on our servers.
  • d) You may not use the Services to sell contact lists or send email to any purchased lists (i.e. “Safe Lists”).
  • e) You may not use the Services to send spam or bulk unsolicited messages. We may terminate with or without notice the account of any user who sends spam.
B: Enforcement
  • 1 Your Services may be suspended or terminated with or without notice upon any violation of this AUP. Any violations may result in the immediate suspension or termination of your account.
  • 2 Mondoze Malaysia reserves the right to disable or remove any content which is prohibited by this AUP, including to prevent harm to others or to Mondoze Malaysia or the Services, as determined in Mondoze Malaysia’s sole discretion.
  • 3 Violations will be reported to law enforcement as determined by Mondoze Malaysia in its sole discretion.
  • 4 A failure to respond to an email from our abuse team within forty-eight (48) hours, or as otherwise specified in the communication to you, may result in the suspension or termination of your Services.
  • 5 Websites hosted on Mondoze Malaysia’s servers in the U.S. are generally governed by U.S. law. As a web host, Mondoze Malaysia is not the publisher of user generated content and we are not in a position to investigate the veracity of individual defamation claims. Rather, we rely on the legal system and courts to determine whether or not material is defamatory. In any case in which a court of competent jurisdiction, as determined in Mondoze Malaysia’s sole discretion, orders material to be removed, Mondoze Malaysia will disable access to such material.
  • 6 Notwithstanding the foregoing, Mondoze Malaysia users are responsible for using the Services in compliance with applicable laws in their jurisdiction, including without limitation, any laws relating to defamation, unsolicited emails, spamming, privacy, obscenity, and intellectual property infringement. Mondoze Malaysia reserves the right to take local legal considerations into account and to respond accordingly in Mondoze Malaysia’s sole discretion.
  • 7 Enforcement of this AUP is at Mondoze Malaysia’s sole discretion.

C: Suspension of Services

Suspension of services may be caused by abuse and violations of system or network security. These offenses may result in suspension, cancellation, or criminal and civil liability. Using Mondoze’s network, services, or systems to store or send content that is illegal according to the laws of Malaysia or Singapore is not permitted for any reason. Examples of system or network abuse or security violations include, without limitation, the following:

1. Hacking

Unauthorised access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without express authorisation of the owner of the system or network.

2. Unauthorised Monitoring

Unauthorised monitoring of data or traffic on any network or system without express authorisation of the owner of the system or network.

3. Interference

Interference with service to any user, host or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system and broadcast attacks.

4. Forging

Forging of any TCP-IP packet header or any part of the header information in an email or a newsgroup posting.

5. Offensive Material

Use of Mondoze service to transmit any material (by e-mail, uploading, posting or otherwise) that threatens or encourages bodily harm or destruction of property.

6. Fraud

Use of Mondoze  service to commit fraud which including and not limiting to fake investment websites, speculation websites, fake banks and investment institution.

7. Virus, Trojan and Malware Distribution

Use of Mondoze service to distribute Virus or any other forms of data which can cause considerable harms to any network. Using or storing any type of software which is designed to or is likely to abuse or negatively impact Internet service, including, but not limited to, port scanners, hacking tools, ping flooding programs, security/root exploits, packet sniffers, and spam software.

8. Terrorism Activities

Use of Mondoze  services to promote terrorist activities which including and not limiting to forums for terrorists, personal websites for terrorists, audio, photo and videos of terrorist activities.

9. System Resources Overload

Overload of Mondoze services until the system performance or other customers’ business is affected which including and not limiting to CPU resources overload, bandwidth overload, memory resources overload, MySQL connections overload, and massive email spamming by scripts.

10. Bandwidth Fair Usage Policies

Mondoze provides unmetered data on VPS, Cloud Servers, Shared/Reseller Hosting, Colocation, and Dedicated Server packages which offer generous fair use data transfer. Data transfer covers bandwidth usage Nationally per month unless otherwise stated as is the case with our Colocation and Dedicated Server plans where this bandwidth policy extends to International data.

Customers may use this data for any purpose other than those unacceptable as stated in our Acceptable Use Policy. Your server will be limited to 128kb/s for both National and International traffic. Please contact our Support Desk should you wish to purchase a dedicated bandwidth.

Should Mondoze  deem a customer’s account as exceeding fair use bandwidth consumption which causes interference with other users, Mondoze will notify the customer and allow the customer to remedy the problem. However, should a customer’s bandwidth usage be significantly greater than fair use, Mondoze reserves the right to suspend or throttle the customer’s account where appropriate.

11. Spam (UNSOLICITED EMAIL)

Customer shall not transmit or disseminate unsolicited commercial e-mail (UCE), or unsolicited bulk messages (Spam), including advertisements, informational distributions, and charitable or other solicitations. Nor shall Customer utilise UCE or Spam to promote or benefit any sites or businesses that are located on the Mondoze network, nor to collect responses from UCE or Spam regardless of whether sent over the Mondoze network. Do not violate the CAN-SPAM Act of 2003. Do not send E-Mail Marketing Messages or facilitate E-Mail Marketing, even if such conduct is CAN-SPAM compliant. Do not host or allow to be hosted any site or information that is advertised by E-Mail Marketing, even if such conduct is CAN-SPAM compliant. Customer may not send or attempt to send e-mail messages or transmit any electronic communications using a name or address of someone other than Customer for purposes of deception. Any attempt to impersonate someone else by altering source IP address information or by using forged headers or other identifying information, including the domain name is prohibited. Any attempt to fraudulently conceal, forge, or otherwise falsify Customer’s identity in connection with use of the Service is prohibited. Confirmed Opt-In (also known as Double Opt-in), is the only method we allow for the e-mail lists operated by our customers.

11. Adult Contents

Virtual Shared Servers
Because the Internet is a global communication tool, and we have clients from nearly every country in the world it is difficult to dictate what is considered “adult material.” However, it is not our function to discriminate against those who choose to utilize adult content or adult-related material. This being said, there are still several reasons why Mondoze ®️ has been forced to create its no adult sites policy for its virtual and bulk reseller server users, including but not limited to direct customers, resellers, and resold accounts.
What does Mondoze ®️ consider “Adult Material”?
1. Any site whose revenue is gained in part or whole from its adult content.
2. Photos or videos showing frontal nudity on either men or women for non-scientific or non-artistic purposes.
3. Hyperlinks to adult sites, including but not limited to sites who violate these policies.
4. Sites that have discussion boards and share information that is ‘adult’ in nature.
5. Sites that sell or promote ‘adult’ material, including but not limited to adult toys.
Mondoze®️ reserves the right to decide what it considers “adult content”, “adult material”, “sexually explicit”, or “sexually related”. Let us know if you are unsure of the approval of your site before placing an order. Please email sales@mondoze.com.my for review of your content and/or site.
